Welcome to Hi Maestro. These Terms & Conditions ("Terms") govern your access to and use of our website at www.himaestro.com (the "Website") and our application at app.himaestro.com (the "App"), collectively referred to as the "Service." The Service is operated by Hi Maestro, Inc. ("Hi Maestro," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Service.

1. Description of the Service
Hi Maestro is a retirement planning tool that allows you to enter financial information, generate retirement projections, explore scenarios, and receive plan improvement ideas. The Service is designed for informational and educational purposes only.
The Service does not connect to, access, or import data from your bank accounts, brokerage accounts, or any other financial institutions. All financial information used by the Service is entered manually by you.

2. Not Financial, Tax, or Legal Advice
This is the most important section of these Terms. Please read it carefully.

Hi Maestro is not a financial advisor, tax advisor, investment advisor, or legal advisor. The Service does not provide financial advice, investment advice, tax advice, or legal advice of any kind.

The projections, calculations, scenarios, ideas, and other outputs provided by the Service are based on the information you enter and a set of assumptions and estimates. These outputs are hypothetical illustrations and are not predictions, guarantees, or recommendations. Actual results will vary, potentially significantly, from what the Service projects.

You should not rely solely on the Service to make financial decisions. We strongly recommend that you consult with a qualified financial advisor, tax professional, or legal advisor before making any significant financial decisions, including decisions about retirement planning, investment strategies, Social Security claiming, property transactions, or any other matter addressed by the Service.
 

By using the Service, you acknowledge that you understand and accept these limitations.

3. Account Registration
To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately if you become aware of any unauthorized use of your account.

4. Eligibility
The Service is available to users who are 13 years of age or older. By using the Service, you represent that you meet this age requirement. We do not knowingly collect personal information from children under 13 in accordance with COPPA (Children's Online Privacy Protection Act).

5. Pricing, Subscription, and Payment

The Service offers free and paid Maestro tiers. The free tier provides access to a limited set of features as described on the Website and App. Pricing for the Maestro tier, including available billing periods and rates, is described on the Website and App. We reserve the right to change pricing at any time. Price changes will apply to new subscriptions and renewals after the change takes effect. Price changes will not affect your current billing period.

 

Payment processing
All payments are processed by Stripe, our 3rd party payment processor. By subscribing to a paid Maestro tier, you agree to Stripe's terms of service. We do not collect, store, or have access to your credit card number or banking details.
 

Automatic renewal
Subscriptions renew automatically at the end of each billing period (quarterly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription price at each renewal.

Cancellation
You may cancel your subscription at any time through the subscription management area accessible from the Service. Upon cancellation, you will retain access to Maestro features through the end of your current paid billing period. After that period ends, your account will revert to the free tier. Your data will be retained unless you explicitly ask to have it deleted.
 

Refunds
Quarterly plans: No refunds or credits for partial billing periods.
Annual plans: If you cancel within 14 days of your initial annual subscription purchase, you may request a full refund by contacting us at support@himaestro.com. After 14 days, no refunds will be issued, but you will retain access through the end of your annual billing period.

6. Your Data
Ownership
You retain ownership of all information and data you enter into the Service. Hi Maestro does not claim ownership of your financial data, personal information, or any other content you provide.

License to use your data
By using the Service, you grant Hi Maestro a limited, non-exclusive license to use, process, and store your data solely for the purpose of providing and improving the Service. This includes processing your data through 3rd party services as described in our Privacy Policy (such as AI-powered plan analysis).
 

No sale of your data
We do not sell, rent, or trade your personal or financial data to 3rd parties. If this practice were ever to change, we would notify you in advance and provide you with the opportunity to opt out or delete your account before any such change takes effect.
 

Data retention and deletion
Your data is retained for as long as your account is active, including if you downgrade to the free tier. You may request deletion of your account and all associated data at any time through account settings or by contacting us at support@himaestro.com. For more details, see our Privacy Policy.

7. Accuracy of Information
The quality of the Service's outputs depends on the accuracy and completeness of the information you provide. You are responsible for ensuring that the financial information you enter is accurate and up to date.
 

Hi Maestro makes no guarantees about the accuracy, completeness, or reliability of the projections, calculations, or other outputs generated by the Service. These outputs are estimates based on assumptions that may not reflect your actual future circumstances, including but not limited to changes in tax laws, inflation rates, investment returns, Social Security benefits, healthcare costs, and life expectancy.

8. Acceptable Use
You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations

• Attempt to gain unauthorized access to the Service, other user accounts, or our systems

• Use the Service to collect or store personal information about other individuals without their consent

• Interfere with or disrupt the operation of the Service

• Reverse engineer, decompile, or disassemble any part of the Service

• Use automated tools, bots, or scripts to access or interact with the Service without our prior written consent

• Reproduce, distribute, or create derivative works based on the Service

• Misrepresent your identity or affiliation when using the Service

• Use the Service to provide financial advisory services to others without appropriate professional licensing

9. Intellectual Property
The Service, including its design, features, content, MaE-3 character, branding, logos, and underlying software, is owned by Hi Maestro, Inc. and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
"Hi Maestro," the Hi Maestro logo, "Mae," and "MaE-3" are trademarks of Hi Maestro, Inc. You may not use these trademarks without our prior written permission.

10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE PROJECTIONS, CALCULATIONS, OR OTHER OUTPUTS GENERATED BY THE SERVICE. YOU USE THE SERVICE AND RELY ON ITS OUTPUTS AT YOUR OWN RISK.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HI MAESTRO, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification
You agree to indemnify, defend, and hold harmless Hi Maestro, Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: your use of the Service, your violation of these Terms, your violation of any applicable law or regulation, any financial decisions you make based on information provided by the Service, or any dispute between you and a 3rd party relating to your use of the Service.

13. Termination
Termination by you
You may stop using the Service and delete your account at any time.

Termination by us
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease.

Effect of termination
If your account is terminated, you may request a copy of your data or request that your data be deleted by contacting us at support@himaestro.com. If you have an active paid subscription at the time of termination by us (for reasons other than a breach of these Terms), we will provide a prorated refund for the unused portion of your billing period.

14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any dispute with Hi Maestro, Inc. arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA) in San Diego County, California. The arbitrator's decision shall be final and binding.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

To the extent that arbitration is found not to apply, any legal proceedings shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the jurisdiction of such courts.

15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and may notify you by email or by placing a notice within the Service. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms.

16. General Provisions
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hi Maestro, Inc. regarding the Service and supersede any prior agreements.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

No agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Hi Maestro.
